Welcome to Jaida.ca (“Jaida”, “we”, “us”, “our”). We operate this website and store, including all related information, content, features, tools, products, and services (the “Services”). Our store is powered by Shopify, which enables us to provide the Services.
These Terms of Service (the “Terms”) together with any policies referenced here describe your rights and responsibilities when you use the Services. By visiting, interacting with, or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Services.
1. ACCESS AND ACCOUNT
You represent that you are the age of majority in your province/territory of residence and you consent to any minor dependents using the Services on devices you own or manage. You may be asked to provide accurate and current information (e.g., email, billing, payment, shipping). You’re responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You may not transfer or assign your account.
2. OUR PRODUCTS
We aim to describe and display products accurately; however, colours and appearance may vary due to device settings. Product descriptions, pricing, and availability may change without notice. We may limit quantities or discontinue items at any time, including by region or customer.
3. ORDERS
Your order is an offer to purchase. We may accept or decline any order at our discretion. Orders are accepted once payment is processed and you receive an order confirmation. Please review carefully before submitting; we may be unable to cancel after acceptance. If we decline or modify an order, we will try to notify you using the contact details provided.
Your purchases are subject to our Refund/Return & Exchange Policy. You confirm purchases are for personal/household use, not for resale or export.
4. PRICES AND BILLING
Prices, promotions, and discounts may change without notice. The price charged is the price in effect at the time of order and will appear in your confirmation. Unless stated otherwise, prices exclude taxes, shipping, and any customs/import charges.
You agree to provide current, complete, and accurate purchase and payment information and to promptly update it. You represent you’re authorized to use the chosen payment method and will pay all amounts due (including taxes and shipping).
5. SHIPPING AND DELIVERY

6. INTELLECTUAL PROPERTY
All content and materials in the Services (including trademarks, designs, text, graphics, images, video, audio, and their arrangement) are owned by Jaida, our licensors, or partners and are protected by Canadian and international intellectual property laws. You may use the Services for personal, non-commercial purposes only. No rights are granted except as expressly stated. “Jaida” names and marks are our trademarks; Shopify’s names and marks are trademarks of Shopify. Other names and marks belong to their respective owners.
7. OPTIONAL TOOLS AND NEW FEATURES
We may provide access to third-party tools or features we do not control. They are provided “as is” and “as available” without warranties or endorsements, and your use is at your own risk and subject to the third party’s terms. Any new features are part of the Services and subject to these Terms.
8. THIRD-PARTY LINKS
The Services may link to third-party websites or materials. We do not control or endorse, and are not responsible for, third-party content, products, policies, or practices. Access and use them at your own risk. Address complaints or questions directly to the third party.
9. RELATIONSHIP WITH SHOPIFY
Our store is powered by Shopify. Sales are made by Jaida, not by Shopify. By using the Services, you acknowledge that Shopify is not responsible for your purchases from Jaida and is released from claims arising from such transactions.
10. PRIVACY
Personal information collected through the Services is handled per our Privacy Policy and may also be processed by Shopify under its privacy policy. Because the Services are hosted by Shopify, information you submit may be processed in other countries to provide and improve the Services. See our Privacy Policy for details.
11. REVIEWS AND FEEDBACK
If you submit reviews, ideas, suggestions, or other content (“Feedback”), you grant Jaida a perpetual, worldwide, transferable, sublicensable, royalty-free license to use, reproduce, modify, publish, and display the Feedback for any purpose. You represent you have the necessary rights, that you will disclose any incentives, and that your Feedback complies with these Terms and applicable law. We may (but are not obliged to) monitor, edit, or remove Feedback we deem objectionable or unlawful.
12. ERRORS, INACCURACIES, AND OMISSIONS
From time to time the Services may contain errors or omissions (e.g., descriptions, pricing, promotions, shipping charges, transit times, availability). We may correct or update this information or cancel orders affected by inaccuracies at any time without notice (including after submission).
13. PROHIBITED USES
You may not use the Services for unlawful, harmful, or abusive purposes; infringe rights; transmit malware; harvest data; send spam; impersonate others; circumvent security; or otherwise interfere with the Services. We may suspend or terminate access for violations.
14. TERMINATION
We may suspend or terminate your access at any time in our discretion. You remain liable for amounts due up to termination. Sections that by nature should survive (e.g., IP, Feedback, Disclaimers, Limitation, Indemnity, Governing Law) will survive.
15. DISCLAIMER OF WARRANTIES
Except as expressly stated by Jaida, the Services and all products are provided “as is” and “as available.” We do not guarantee uninterrupted, timely, secure, or error-free use, or that descriptions or content are accurate or complete.
Some jurisdictions do not allow the exclusion of certain implied warranties; to the extent required by law, your statutory rights are not affected.
16. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Jaida and our officers, directors, employees, agents, affiliates, contractors, service providers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, savings, data, or replacement costs, arising from or related to your use of the Services or products.
Nothing in these Terms limits liability to the extent it cannot be limited under applicable law (including for fraud or wilful misconduct). Your statutory rights remain.
17. INDEMNIFICATION
You agree to indemnify and hold harmless Jaida and our affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Services.
18. SEVERABILITY
If any provision is unlawful or unenforceable, it will be enforced to the maximum extent permitted and the remainder will remain in effect.
19. WAIVER; ENTIRE AGREEMENT
A failure to enforce a provision is not a waiver. These Terms and policies referenced here constitute the entire agreement between you and Jaida regarding the Services and supersede prior understandings.
20. ASSIGNMENT
You may not assign these Terms without our prior written consent. We may assign or transfer these Terms without notice.
21. GOVERNING LAW AND JURISDICTION
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflicts of law. You submit to the exclusive jurisdiction of the courts of Ontario, located in Toronto, Ontario, for all disputes arising out of or relating to the Services, subject to any consumer-protection rights you may have under applicable law.
22. HEADINGS
Headings are for convenience only and do not affect interpretation.
23. CHANGES TO THESE TERMS
We may update these Terms from time to time. We will post the revised Terms with an updated “Last updated” date and provide notice as required by law. Your continued use after changes become effective constitutes acceptance.
